Terms of Service for Whakamana Teen Dance Club

These Terms of Service (the “Terms“) are a legally binding agreement between you and Whakamana Teen Dance Club (“Whakamana,” “we,” “us,” or “our“) governing your access to and use of https://whakamanaclub.com/ and any related pages, forms, content, memberships, communications, and online services we provide through the Site.
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
If you are a parent or legal guardian using the Site on behalf of a teen, you represent that you have the authority to act for that teen in connection with membership, consent, payment, and communications.
1. Site Purpose
Whakamana operates a teen-focused membership club and related website content for dance events, schedules, membership information, communications, and club updates. The Site is for informational, communication, and membership-related purposes only.
2. Eligibility
You must be 18 years of age or older to use this SMS service. The Site, online registration tools, purchases, and SMS opt-in features are intended for use by parents, legal guardians, and other adults who are 18 years of age or older. Persons under the age of 18 are not permitted to use or register through the Site on their own.
Club participation and youth membership are intended for teens who meet Whakamana’s eligibility requirements, including age, approval, and parent or guardian consent requirements. A parent or legal guardian may be required to complete consent, waiver, release, billing, or membership documents before a teen may attend events or receive membership benefits.
We reserve the right to approve, deny, suspend, or revoke any membership, application, or access based on safety, conduct, eligibility, documentation, payment status, or policy compliance.
3. Accounts, Applications, and Submitted Information
If the Site allows membership applications, registrations, subscriptions, or contact submissions, you agree to provide accurate, current, and complete information. You agree not to submit false, misleading, or incomplete information.
You are responsible for keeping your submitted contact information reasonably current so we can communicate about approvals, schedules, payments, policy updates, and club operations.
4. Parent/Guardian Responsibility
Where a teen membership, waiver, consent, release, emergency contact, or house-rule acknowledgment is required, the applicable parent or legal guardian is responsible for ensuring the information submitted is accurate and for reviewing any required documentation before the teen participates.
Attendance at in-person activities may remain subject to separate parental consent, release, liability waiver, code-of-conduct, or membership documentation, even if a teen or parent has used the Site.
5. Memberships, Fees, Billing, and Cancellation
Whakamana may offer free or paid membership plans, recurring monthly memberships, household plans, promotions, or guest-related benefits as described on the Site.
By purchasing a paid membership, you agree to pay all applicable fees, charges, and taxes associated with the selected plan. If recurring billing applies, you authorize the applicable payment processor to charge the payment method provided according to the plan terms presented at checkout.
Based on the current Site language, memberships are described as having no joining fee and being cancellable anytime. You should confirm the exact cancellation method, whether cancellation applies immediately or at the end of the current billing period, and whether any refunds or prorated credits are offered. Unless separately stated in writing, fees already paid are non-refundable to the fullest extent permitted by law.
We may suspend or terminate membership-related access if payment fails, is reversed, or is disputed, or if required eligibility or consent documentation is missing or withdrawn.
6. SMS Messaging Terms
If you opt in to receive SMS or text messages from Whakamana, you agree to receive recurring automated and non-automated text messages related to membership applications, approval updates, parent or guardian consent reminders, billing notices, account notices, club announcements, event reminders, schedule updates, customer-care responses, and occasional promotional messages.
Message and data rates may apply. Message frequency may vary. You may opt out at any time by replying STOP to any message. Consent to receive text messages is not a condition of purchase.

7. Code of Conduct and Club Rules
Use of the Site and participation in Whakamana activities must comply with all posted rules, membership conditions, club expectations, and any separate code of conduct or venue policies communicated by Whakamana.
You agree not to use the Site or Whakamana-related communications to:
•harass, threaten, abuse, or impersonate others;
•submit false applications or false parental information;
•interfere with site operations or security;
•upload malicious code or harmful material;
•collect information about others without authorization;
•use the Site for unlawful purposes; or
•engage in conduct inconsistent with a safe youth environment.
We reserve the right to investigate suspected violations and to remove content, deny access, suspend memberships, or take other action we believe is appropriate.
8. Intellectual Property
Unless otherwise stated, the Site and its content, including text, graphics, branding, logos, photographs, videos, audio, design elements, and compiled materials, are owned by or licensed to Whakamana and are protected by applicable intellectual-property laws.
You may access and use the Site for your personal, non-commercial use only. You may not copy, reproduce, republish, distribute, modify, scrape, exploit, or create derivative works from Site content without our prior written permission, except as allowed by law.
9. User Feedback and Submissions
If you send us suggestions, comments, feedback, testimonials, or similar submissions, you grant us a non-exclusive, royalty-free right to use, reproduce, display, and incorporate that feedback for business purposes, subject to applicable law and our Privacy Policy.
If you submit content or information to us, you represent that you have the right to do so and that doing so does not violate any law or the rights of another person.

13. Limitation of Liability
To the fullest extent permitted by law, Whakamana and its owners, operators, staff, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site.
To the fullest extent permitted by law, our total liability for claims arising out of or related to the Site will not exceed the greater of: (a ) the amount you paid to us through the Site during the three months preceding the event giving rise to the claim, or (b) $100.
Nothing in these Terms limits liability where such limitation is prohibited by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Whakamana and its owners, operators, affiliates, employees, contractors, and agents from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
•your use of the Site;
•your breach of these Terms;
•your violation of law; or
•your infringement of the rights of another person or entity.
If you are a parent or legal guardian submitting documents, information, or payments through the Site, this indemnity also applies to claims arising from inaccurate or unauthorized submissions made by or on behalf of your household, to the extent permitted by law.
15. Termination
We may suspend, restrict, or terminate your access to the Site or any membership-related features at any time, with or without notice, if we believe you violated these Terms, club policies, law, or safety expectations, or if continued access would create risk for our operations, staff, or members.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site shall be brought exclusively in the appropriate state or federal courts located in Maryland, unless applicable law requires otherwise.
17. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the Site after revised Terms are posted means you accept the updated Terms.
